2. Petitioner seeks regular bail in connection with Karpurigram P. S. Case No. 28 of 2025 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 .
3. As per the prosecution case, 31.3 liters of English liquor were recovered from Mango Orchard and two motorcycles were also recovered from the spot.
4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is not the owner of the mango orchard and he has no concern with the alleged recovery. No incriminating material has been recovered from conscious
Patna High Court CR. MISC. No.42130 of 2025(2) dt.08-08-2025 2/2 possession of the petitioner. Petitioner is in custody since 19.04.2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-I, Samastipur in connection with Karpurigram P. S. Case No. 28 of 2025.
