Petitioners seek bail in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016 and Section 197 and 192(2) of the Motor Vehicle Act, 1988.

Petitioners are driver and cleaner of the truck from which huge quantity of liquor was recovered. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 23.06.2020.

Considering the facts aforesaid, let the petitioners, above named, be released on bail after framing of the charge

Patna High Court CR. MISC. No.38642 of 2020(2) dt.02-03-2021 2/2 if it has not been framed up-till-now on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barachati Police Station Case No.367 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below having immovable property.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
