29-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Mushahari P.S. Case No. 27 of 2019 (G.R. No. 479 of 2019), registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, on 25.01.2019, three persons hired the car of informant for Muzaffarpur and when they reached near Dwarika Nagar Power Greed, they told the informant to stop the vehicle and thereafter, they pushed the informant from the car and took away his vehicle alongwith his mobile phone, Aadhar card and Driving license. It is submitted on behalf of petitioner that FIR has been lodged against unknown and name of the petitioner has come during course of investigation on the basis on confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner and till date,

Patna High Court CR. MISC. No.51671 of 2021(2) dt.29-11-2021 2/2 petitioner has not been put on T.I.P. Petitioner is in custody since 05.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Muzaffarpur in connection with Mushahari P.S.
