The petitioner seeks bail in a case registered for offences under Sections 30 (a) and 38(1) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 220 litres of country-made liquor were allegedly recovered from a gunny bag kept in Upasana Express train which is said to be owned by the petitioner who was apprehended by the police in toilet of the train. Petitioner claims that he is having clean antecedent and is in custody since 03.05.2017.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.40564 of 2017(2) dt.25-08-2017 2/2 case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Lakhisarai in connection with Rail Jhajha Case No. 109 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
