Md. Matlub Rab, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 08-02-2022 Heard learned counsel for the petitioner and Shri Matlub Rab, learned A.P.P. for the State through virtual Court proceedings.

The petitioner seeks bail in connection with Hilsa P.S. Case No. 631 of 2020 instituted for the offences under Sections 395 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, charge-sheet has been submitted in the case and has antecedent of four cases as mentioned in the supplementary affidavit which has been filed on 19.01.2022 as inadvertently in paragraph '3' of the bail application it has been recorded that petitioner has no criminal antecedent.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.51813 of 2021(2) dt.08-02-2022 2/3 allegation is of looting pickup van and mobile of the informant by unknown criminals.

Learned counsel for the petitioner submits that name of the petitioner transpired in the confessional statement of coaccused Narayan Kumar and Md. Bittu that they along with the petitioner looted the pickup van and sold the same for Rs. 80,000/- to Mahalakshmi Garage from where the pickup van was recovered.

Learned counsel for the petitioner submits that admittedly it was based on the confessional statement that the name of this petitioner transpired and it was at the instance of Narayan Kumar that the alleged pickup van was recovered from Mahalakshmi Garage.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that once the petitioner is enlarged on bail then he will abscond as he has antecedent of four cases and will try to delay the trial of the case by not allowing the charges to be framed.

Considering the fact that the petitioner is in custody since 24.12.2020, charge-sheet has been submitted in the case and his name transpired in the confessional statement of coaccused, let the petitioner above named be released on bail on

Patna High Court CR. MISC. No.51813 of 2021(2) dt.08-02-2022 3/3 furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa in connection with Hilsa P.S. Case No. 631 of 2020. The petitioner shall be released after framing of charges.
