Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of loot of a Bolero vehicle carrying medicines is against unknown. During investigation some of the looted medicines were recovered from the house of the petitioner and name of the petitioner surfaced in the confessional statement of co-accused.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.02.2020. He was never put on Test Identification Parade nor the medicines were put on Test Identification Parade. Co-accused Tuntun Kumar Pandit has already been allowed bail by a coordinate Bench of this Court vide order at Annexure-2.

No.38611 of 2020(3) dt.12-04-2021 2/2 Considering the facts aforesaid as well as completion of investigation and no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jandaha P.S. Case No.11 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
