The petitioner seeks pre-arrest bail in connection with Brahmpur (Krishna Brahm) P.S. Case No.22 of 2015 registered under sections 406, 420 read with 34 of the Indian Penal Code as also sections 3 and 4 of the Dowry Prohibition Act. It is contended that father of the petitioner, namely, Rajendra Prasad, who has also been made co-accused in this case and whose case is identically situated to that of the petitioner has already been granted anticipatory bail vide order dated 21.92015 passed in Cr. Misc. No.23501 of 2015.
Learned counsel for the State has contended that the petitioner being main accused does not deserve privilege of
Patna High Court Cr.Misc. No.49240 of 2015 (2) dt.02-11-2015 2/2 anticipatory bail even though his father has been granted anticipatory bail by a co-ordinate Bench of this Court. Regard being had to the nature of allegation and the reasons assigned in the aforesaid order dated 21.9.2015 passed in Cr. Misc. No.23501 of 2015, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur (K.B.) P.S. Case No.22 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
