JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner, the State, the informant and perused the case diary.

The petitioner seeks regular bail in registered for the offences punishable under sections 379, 307/34 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, petitioner shot at the informant causing fire arms injury on his lift side chest. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that the timing of occurrence has not been disclosed by the informant in the FIR. There is general and omnibus allegation against the petitioner and other accused persons. Petitioner is in custody since 20.7.2021. Learned counsel for the State and the informant oppose the prayer for bail and submits that it was the petitioner who made firing on the victim causing fire arms injury on the left side chest.
