Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, Sections 25(1-b)a, 26,35 of the Arms Act and Section 8(c),20,21,22 of the N.D.P.S.Act.

Petitioner is in custody since 01.08.2020. When a four wheeler was intercepted, four persons including the petitioner were there. From possession of the petitioner, a loaded pistol and cartridge was recovered, besides that Ganja was recovered in three packets, each of about 01 Kg. Petitioner has got criminal antecedent.

Considering the nature of allegation and available material, I am not inclined to enlarge the petitioner on bail for

Patna High Court CR. MISC. No.38298 of 2020(4) dt.17-03-2021 2/2 the present in connection with N.D.P.S.Case No.62 of 2020 arising out of Minapur P.S.Case No.284 of 2020 pending in the court of learned Sessions Judge-cum-Special Judge, N.D.P.S., Muzaffarpur. Hence, prayer is refused.

However, if the trial is not concluded within nine months from the date of receipt/production of a copy of this order, petitioner would renew prayer.
