JUSTICE RAKESH KUMAR ORAL ORDER 16-10-2015 Heard Sri Vijay Kumar, learned counsel for the petitioners and Sri Binod Kumar, learned A.P.P. Two petitioners, apprehending their arrest in connection with Complaint Case No. 1745 of 2013 filed under Section 420, 467, 468, 120(B) of the Indian Penal Code in which cognizance order has been passed under Section 420 of the Indian Penal Code, have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that it has been alleged that one of the co- accused had tried to transfer the land of the complainant to the petitioner no. 1 in which the petitioner no. 2 stood as witness. He submits that primarily it is a
Patna High Court Cr.Misc. No.47687 of 2015 (2) dt.16-10-2015 2/2 case of civil nature and colour of criminal offence has been given. In view of the nature of accusation, in the event of arrest or surrender within a period of eight weeks from today, let both the petitioners namely Hiralal Rai and Ram Pukar Rai be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri M.P. Yadav, learned Judicial Magistrate, Saran at Chapra, in connection with Complaint Case No. 1745 of 2013 vide Tr. No. 1761 of 2015.
