The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 15.3 litres foreign liquor was recovered from the possession of the accused persons including the petitioner. Petitioner is in custody since 06.08.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge - cum-A.D.J. 4th, Kaimur at

Patna High Court Cr.Misc. No.52501 of 2017(2) dt.09-11-2017 2/2 Bhabua in connection with Excise Case No. 1320 of 2017 arising out of Babhua P.S. Case No.475 of 2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
