ANJANA PRAKASH ORAL JUDGMENT Date: 11-05-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 2.1.2013 by which the Judicial Magistrate, 1st Class, Gaya, has refused to discharge the Petitioner in Nimchak Bathani P.S. Case No. 4 of 2005.
Considering that the Petitioner seeks quashing on questions of fact, I am not inclined to interfere in the matter. The application is dismissed.
The Trial Court is directed to conclude the Trial expeditiously without granting unnecessary adjournment to any Party for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of
Patna High Court Cr.Misc. No.8763 of 2013 dt.11-05-2015 2/2 this order in connection with Nimchak Bathani P.S. Case No. 4 of 2005, to the Superintendent of Police, Gaya, and the Superintendent of Police, Gaya, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
