2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 30(a), 41(1) of the Bihar Prohibition & Excise Act.

3. As per allegation in the FIR, petitioner was arrested on 21.3.2025 with a bag containing 22 liters of country made liquor and since then he is languishing in judicial custody.

4. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.41475 of 2025(2) dt.04-07-2025 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. He has no concern with the alleged liquor and he is simply a victim of false implication in the instant case at the instance of his enemies. Proper procedure of search and seizure has not been followed in this case. Moreover, the petitioner is languishing in judicial custody since 21.03.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail, after framing of charge, in connection with Raghunathpur P.S. Case No. 71 of 2025 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court I, Motihari, East

Patna High Court CR. MISC. No.41475 of 2025(2) dt.04-07-2025 3/3 Champaran, with following condition:- (i) One of the bailors should be close relative or family member of the petitioner.
