The petitioner is in judicial custody in connection with Punaura P.S. Case No. 94 of 2021 under section 392 of the Indian Penal Code.

The short F.I.R. states that on 12.6.2021 the informant was sitting at his shop with Rs. 80000/- in a bag. Meanwhile, the accused persons came to the shop in the garb of charging their mobiles and later after threatening him with a pistol decamped with that bag. FIR was lodged against unknown.

Subsequently, in course of the investigation, the name of this petitioner has cropped in and it was under these

Patna High Court CR. MISC. No.52671 of 2021(6) dt.20-04-2022 2/3 circumstances that he came into the judicial custody and is in jail since 12.7.2021 as stated in para-11 of the bail application.

Learned counsel further submits that he is a student and has annexed document to show he has appeared under Lalit Narayan Mithila University B.A. (Hons.) examination.

Taking into account the aforesaid facts, this Court is inclined to grant him the privilege of bail. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Punaura P.S. Case No. 94 of 2021 subject to the following conditions:- (i) one of the bailors should be the family members of the petitioner, who will provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself; (iii) he shall appear before the concerned police

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall take steps for cancellation of his bail bonds.
