The petitioner apprehends his arrest in Bidupur P.S. Case No. 228/2015, registered for the offences punishable under Section 376 of the Indian Penal Code.

The prosecutrix made allegation that the petitioner took her for providing job but the petitioner established physical relation with her on the pretext of marriage and later on she was thrown out from the house when the prosecutrix insisted for marriage.

It is submitted that the victim-prosecutrix is a major girl and she was consenting party. The case is compromised. Taking into consideration that the prosecutrix made specific allegation against the petitioner that on the pretext of

Patna High Court Cr.Misc. No.40896 of 2015 (2) dt.06-10-2015 2/2 marriage he established physical relation with her, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
