JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents and brothers of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The accusation is of killing the daughter of the informant after 13 years of marriage for non fulfillment of dowry demand of car.

It is submitted by the learned counsel for the petitioners that the accusation is not specific against the petitioners. The victim met with accident while going to ease out near the railway

Patna High Court Cr.Misc. No.39987 of 2015 (2) dt.06-10-2015 2/2 track. It is further submitted that the accusation of demanding dowry after 13 years of marriage appears to be unreasonable. The children of the victim have not supported the accusation. The informant has retracted from the initial version and has filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Barun P.S. Case No.27 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
