JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sikandra P.S. Case No. 94 of 2017 for the offences punishable under Sections 414, 467, 468, 471, 484/ 34 of the Indian Penal Code.
The allegation against the petitioner is that upon receipt of secret information that the petitioner and others are engaged in the business of stealing the motorcycle and selling the same after preparation of papers and documents, raid was conducted at the house of the petitioner and one stolen motorcycle was recovered.
The learned counsel for the petitioner submits that the petitioner has a clean antecedent and is in custody since 8.7.2017. It is further submitted that charge sheet has also been
Patna High Court Cr.Misc. No.49972 of 2017 (2) dt.17-10-2017 2/2 submitted in this case and there is no possibility of tampering with the evidence.
In the facts and circumstances of the case, I deem it fit and proper to enlarge the above named petitioner on regular bail upon completion of five months of his custody i.e. from 08.07.2017, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Sikandra P.S. Case No. 94 of 2017 and also subject to other terms and conditions as may be deemed fit and proper by the learned trial court. (Mohit Kumar Shah, J) BTiwary/- U T
