Petitioner apprehends his arrest in Rahui P.S. Case No.117 of 2019, registered under Sections 406 and 420 of the Indian Penal Code.
The informant alleged that she lend Rs.1,00,000/- to the petitioner but on demand the petitioner paid only Rs.19,000/- on 15.08.2016. On repeated demand, the petitioner is said to have given a cheque of Rs.25,000/- but the same on being presented returned due to insufficiency of fund. The petitioner is again said to have given cheque of Rs.90,000/- but that cheque was also bounced.
Learned counsel for the petitioner submits that petitioner never borrowed any money from the informant. Prior to institution of the present case, the petitioner filed complaint
Patna High Court CR. MISC. No.41554 of 2019(2) dt.08-07-2019 2/2 case against the informant of committing forge in procuring the cheque of the petitioner.
Taking into consideration the facts that the petitioner denied to have taken any money and also denied to have issued the cheque duly signed by him, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Rahui P.S. Case No.117 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
