The petitioner seeks regular bail in connection with Brahmpur (Chakki) P.S.Cae no.296 of 2018 registered for offences punishable under Sections 341, 376, 354, 506 of the Indian Penal Code.

Allegation against the petitioner is of committing rape upon the prosecutrix.

Submission of the learned counsel for the petitioner is that he has been falsely implicated and later on a compromise petition has also been filed in this case and the petitioner is in custody since 24.7.2018. The charge-sheet has also been submitted.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.54869 of 2018(4) dt.04-12-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above as well as there is allegation of rape against the petitioner as such at this stage I am not inclined to grant bail to the petitioner but once the trial is commenced and the informant is examined, the petitoner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
