Petitioner seeks regular bail in connection with Govindganj ( Areraj ) PS Case No. 144 of 2021 registered under Section 302 , 201 , 506 , 34 of the I.P.C. and Section 3⁄4 of the Dowry Prohibition Act.

The informant has alleged that about eleven (11) years back marriage of his sister was solemnized with the co-accused Pawan Patwa and petitioner along with other family members tortured and killed the informant's sister due to non fulfillment of demand of dowry and disposed of the dead body clandestinely.

Learned counsel for the petitioner submits that petitioner is the father-in-law of the deceased and marriage was

Patna High Court CR. MISC. No.52200 of 2021(2) dt.22-04-2022 2/2 solemnized about eleven (11) years back and out of wedlock with the co-accused i.e. son of the petitioner two children have born. He further submits that allegation against the petitioner is general and omnibus in nature and petitioner is seventy (70) year old person, he is in custody since 13/05/2021 and charge sheet has already been submitted .

Regard being had to the submissions made by the parties, taking into consideration the materials available on record, nature of allegation, the fact that petitioner is an old person and he is in custody since 13.05.2021, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Chief Judicial Magistrate, Motihari at East Champaran in connection with Govindganj ( Areraj ) PS Case No. 144 of 2021.
