====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Nokha P.S. Case No.160 of 2018 registered under Sections 341, 323, 307 and 379 of the Indian Penal Code besides Section 27 of the Arms Act.
The accusation is that on 12.06.2018, when the informant Jaikky Kumar after getting down from the train at Nokha was going to his village, then, in the way, Lallu Yadav and this petitioner attacked on him through country made pistol, which passed through his head. They again shot fire at the chest of the informant but the same missed. Thereafter, they started to commit "Maar-Peet" with him and took Rs.20,000/- from his pocket and snatched gold chain worth of Rs.30,000/- from his neck and fled away making firing in
Patna High Court CR. MISC. No.54682 of 2018(4) dt.22-05-2019 2/2 air. The cause of occurrence is that Lallu Yadav and this petitioner used to do the business of illicit liquor in the Panchayat of the informant and the informant had given information to the police in this regard.
Learned counsel for the petitioner submits that while the allegation of making firing at the informant against the petitioner and Lallu Yadav has been made in the F.I.R. but the informant did not sustain any injury. In fact, Vivek Kumar, the brother of Lallu Yadav, had lodged Nokha P.S. Case No.161 of 2018 against the informant of the present case and others, due to that reason, the informant has lodged the present case. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Nokha P.S. Case No.160 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
