JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code.

Prosecution's case in short is that this petitioner and two other accused persons caught hold of the informant's son thereafter co-accused Vishal Kumar Singh inflicted knife blow on him causing injuries.

Learned counsel appearing for the petitioners no. 1, 2 and 4 submits that no overt act has been alleged against this petitioner and at best he can be said to have facilitated the offence by catching hold of the victim.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.42352 of 2022(2) dt.29-11-2022 2/2 Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in Katihar Town Police Station Case No. 167 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
