The petitioners seek bail in a case registered for offences under Sections 272, 273 and 224 of the Indian Penal Code and Sections 30(A), 38, 41 and 48 of the Bihar Prohibition and Excise (Amendment) Act, 2016.

It is contended that as per allegation, 4410 litres of foreign liquor were recovered from the truck which was kept under the packets of pulse of thirty bags which was being boarded by two persons including the petitioner no. 1, Vikash whereas the petitioner no. 2, Param Hansh is said to be the

Petitioners claim that they are having clean antecedent and are in custody since 26.05.2017. Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Minapur P.S. Case No. 135 of 2017 with a condition that one of the bailors for each of the petitioners will be the resident of Bihar since the petitioners belong to Haryana. Further, if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
