JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.
The accusation is of taking a stolen red colour Tata Sumo Victa vehicle to Nepal. The driver, Jafir Rain disclosed the name of the petitioner as a person who escaped from the scene after seeing SSB Jawans on the road. It is submitted by learned counsel for the petitioner that except confession of the driver, there is nothing against the petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with
Patna High Court Cr.Misc. No.40032 of 2015 (2) dt.06-10-2015 2/2 Kanhauli P.S. Case No. 63 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Sitamarhi. With the observations above, the application stands disposed off.
