The petitioner seeks bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 302, 504/34 of IPC and u/s 27 of the Arms Act.

Vide order dated 17.08.2022, a report was called for, regarding the stage of trial. In compliance thereof, a report sent by learned Additional Sessions Judge IXth, Siwan dated 01.09.2022, kept at flag 'R', whereby it is submitted that out of 8 prosecution witnesses, five witnesses have been examined, NBW's have been issued to non-official witnesses and B.W.'s have been issued to the official witnesses and the time likely to be taken in conclusion of the trial is about six months, if parties co-operate.

Considering the submissions made in the report, I am not

Patna High Court CR. MISC. No.42335 of 2022(3) dt.21-09-2022 2/2 inclined to grant bail bail to the petitioner named above. The prayer for bail is hereby rejected.

Accordingly, the bail application is dismissed. However, the trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order and if trial is not concluded within the stipulated time, petitioner shall be released on bail by the Court below itself.
