Petitioner no. 2 Sant Lal Singh apprehends his arrest in Hajipur Mahila P.S. Case No. 12 of 2016, registered for the offences punishable under Sections 376, 406 and 34 of the Indian Penal Code.
The prosecutrix made allegation that the petitioner Sant Lal Singh and Ramjee Singh entered into her house and committed rape with her one by one. On alarm, they fled away. Learned counsel for the petitioner Sant Lal Singh submits that the husband of the informant and Ramjee Singh were on litigating term. There a title suit pending which was decided in favour of Ramjee Singh. Wife of Sant Lal Singh filed a
Patna High Court Cr.Misc. No.29830 of 2016 (4) dt.05-10-2016 2/2 case against the informant and her husband for committing rape with her daughter.
It appears from the FIR that the victim as well as other witnesses have stated that the petitioners committed rape with her. The victim also made same and similar allegation in her statement recorded under Section 164 of the Cr.P.C.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner Sant Lal Singh above named on anticipatory bail. Accordingly, the same is rejected.
