Petitioner seeks regular bail in connection with Palasi PS Case No. 100 / 2021 registered under Section 25 (1-b) a / 26 of the Arms Act and Section 4 (b)(i) of the Explosive Substance Act.

One live cartridge, one country made pistol and one live bomb have been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner is in custody since 25 / 05 / 2021 having no criminal antecedent and charge sheet has already been submitted. He next submits that at the time of search and seizure the procedures prescribed under the Cr.P.C. have not been followed

Regard being had to the submissions made by the parties and taking into consideration the material available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 25.05.2021 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Araria in connection with Palasi PS Case No. 100 / 2021.
