JUSTICE SHIVAJI PANDEY ORAL ORDER 14-05-2015 In the present case, the petitioner is challenging the order of cognizance dated 3rd May 2011 passed by Chief Judicial Magistrate, Begusarai for offences under sections 409 and 420 of the Indian Penal Code arising from Bakhari P.S. Case No. 157 of 2010, G.R. No. 2612 of 2010.

Allegation has been made in the first information report that the petitioner got himself involved in misappropriation of the Government fund in the manner that in terms of 12th Finance Commission, Rs. 2,00,000/- (two lacs) was given to him for purchase of sports materials but he has not produced the original document, so much so, he has not submitted the voucher of Rs. 12,351/- (twelve thousand three hundred fifty one) and Rs.154,819/- (One lakh fifty four thousand eight hundred

Patna High Court Cr.Misc. No.12438 of 2013 (2) dt.14-05-2015 2/2 nineteen), on that basis, the court below took cognizance. This Court does not find any error in the impugned order. Accordingly, this petition is dismissed. However, liberty is given to raise all points at the appropriate stage. This order has been passed in presence of the counsel for the State.
