====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 8 (c), 21(b)/25/29 of the NDPS Act.

3. As per the prosecution case, 40 grams Brown Sugar (Heroin) was recovered from the plastic packet possessed by coaccused Sanish Kumar, while petitioner managed to escape.

4. Learned counsel appearing for the petitioner submits that petitioner's name has come in the case on the confessional statement of said co-accused No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 24.8.2023.

5. Learned counsel for the other side opposes the prayer for bail.

5. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
