The petitioner is in custody in connection with Kalyanpur P.S. Case No. 106 of 2020, for the offence under Sections 30(a), 41(i)(ii) and 47 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Petitioner is in custody since 16.09.2020.
In the instant case total 54.440 litres of bear and wine was seized from the house of Rajeshwar Singh. Considering the fact that the petitioner has no criminal antecedent and he is in custody since 16.09.2020, the Court is
Patna High Court CR. MISC. No.38675 of 2020(2) dt.08-02-2021 2/2 inclined to grant bail. The petitioner, named above, is directed to be released on bail, on completion of six months in custody on or before 16th of March, 2020, on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Excise Act, Samastipur in connection with Kalyanpur P.S. Case No. 106 of 2020.
