JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 448, 302, 504 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that F.I.R named accused persons with 15-20 unknown including the petitioners came variously armed and made indiscriminate firing. It is specifically alleged that on the order of co-accused Pappu Yadav, co-accused Birendra Prasad fired causing injury to Sarita Devi who succumbed to the injuries.

It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled when specific overt act has not been alleged against the petitioners.

No.56489 of 2015 (2) dt.17-12-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Fatuha P.S. Case No. 276 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Patna. With the observations above, the application stands disposed off.
