The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 60 of 2014 arising out of Vigilance Unit P.S. Case No. 3 of 2014 instituted for the offences under Sections 13(2) read with 13((i)(e) of the Prevention of Corruption Act, 1988.

Learned counsel submits that the petitioner is wife of the co-accused against whom case under Sections 13(2) read with 13((i)(e) of the Prevention of Corruption Act, 1988, of disproportionate assets has been alleged. The petitioner is an independent income tax payee and she can not be said in any manner to be involved and case for criminal conspiracy is not made out.

No.52877 of 2021(2) dt.18-02-2022 2/2 Considering above aspects, without commenting on merits of the case that the petitioner is wife of the other accused against whom alleged offence for disproportionate assets is mentioned, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest she shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
