ANJANA MISHRA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Complaint Case No. 14746 (C) of 2014 registered for the offence punishable under Section 406 of the Indian Penal Code.
Learned counsel for the petitioners submits that whatever the nature of allegations the petitioners are willing to deposit Rs.10,000/- each in the court below which shall be made available to the complainant on his making an application to the said affect. Counsel for the petitioners further submits that since they are willing to deposit the said Rs.10,000/- each in favour of
Patna High Court Cr.Misc. No.32858 of 2016 (2) dt.27-10-2016 2/2 the complainant, they may be extended the privilege of anticipatory bail.
As such, if the petitioners deposit Rs.10,000/- each in the court below, the court below shall ascertain and ensure that the amount deposited is given back to the complainant and subject to such condition, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Complainant Case No. 14746(C ) of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
