JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 379, 354, 427, 34 of the Indian Penal Code and Section 3(1)(iii)(xi) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that due to some quarrel between the wife of the petitioner and the informant the petitioner went to the house of the informant, dragged her to the courtyard, assaulted her and tried to strip her. It is submitted by learned counsel for the petitioner that on the complaint of the petitioner Circle Officer, after due enquiry got registered Bihta P.S. Case No. 757 of 2014 levelling accusation under Sections 147, 148, 149, 323, 337, 338, 324, 353, 307, 504, 506, 435, 427 of the Indian Penal Code against the husband of the informant and others on 10.10.2014, whereas for the occurrence of 03.02.2015 the

Patna High Court Cr.Misc. No.40054 of 2015 (2) dt.06-10-2015 2/2 complaint was filed by the present informant on 05.02.2015 which came to be registered as police case on 24.02.2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the accusation in the background of strained relationship between the parties from before, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Magistrate, SC/ST, Danapur, Patna in connection with Harijan P.S. Case No. 04 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
