The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
As per the prosecution case, all the FIR named accused persons including petitioner caught hold of the father of informant who was sleeping on a Chowki and co-accused Shambhu Yadav pressed the neck, as a result of which father of informant died.
It is submitted that as per the FIR it was Shambhu Yadav who was pressing the neck of deceased. During course of investigation, the case of prosecution was disbelieved and final form was submitted against this
Patna High Court CR. MISC. No.42605 of 2022(2) dt.01-12-2022 2/2 petitioner. However, differing with the same, learned trial court took cognizance in this case. No specific overt act has been alleged against this petitioner. Petitioner bears clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 41 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
