JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-04-2023 Mr. Arun Kumar Sinha, learned counsel for the petitioner submits that the sole petitioner has died during pendency of the writ application. He has filed one application (I.A. No. 01 of 2022) for substitution of the legal heirs of the sole petitioner. It is submitted that the Interlocutory Application may be allowed but he has instruction to withdraw this writ application.

Learned counsel for the respondents have no objection to the same.

In the circumstances, let I.A. No. 01 of 2022 be allowed. The name of the writ petitioner is expunged and in his

Patna High Court CWJC No.13096 of 2019(5) dt.19-04-2023 2/2 place the name of his wife and legal heir, namely, Vimla Pathak, residing at Ward No. 24, Bettiah, District-West Champaran be substituted.

As prayed, this writ application is permitted to be withdrawn.
