The petitioner apprehends his arrest in a case under section 47A of the Excise Act on the allegation that a huge quantity of liquor was recovered from the house of his father Balmiki Ram and one Darogi Ram. Accused Darogi Ram disclosed that the petitioner and his associate Rajesh Singh and Rupesh Kumar had stored the liquor.

The petitioner submits that except for confession of co-accused, no incrementing item has been recovered from his conscious possession.

In the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Chief

Patna High Court Cr.Misc. No.25487 of 2016 (2) dt.04-07-2016 2/2 Judicial Magistrate, Khagaria in Beldaur Police station Case No. 53 of 2016.

Petitioner would not be absent physically for two consecutive dates at a stretch till two witnesses are examined in the trial, failing which his bail bond would be liable to be cancelled.
