The petitioner seeks bail in a case instituted for the offences under Sections 411, 414/34 of the Indian Penal Code. Prosecution allegation, in short, is that while the informant on patrolling duty, on suspicion, the accused persons were apprehended a stolen motorcycle was recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.3.2019. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. A stolen motorcycle is alleged to have been recovered. The petitioner has no knowledge regarding the motorcycle being

Patna High Court CR. MISC. No.40320 of 2019(2) dt.02-07-2019 2/2 stolen property. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Amour P.S. Case No. 25/2019.
