JUSTICE RAVI RANJAN ORAL ORDER 12-07-2016 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 147, 341, 323, 307, 452, 379, 504 and 506 of the Indian Penal Code.
It is contended on behalf of the petitioners that in fact, the informant is the maternal brother of the petitioner no. 2 and admittedly a title suit is going on between the parties. Allegedly the petitioner no. 1 gave a blow upon the head of the informant with an iron rod, however, the injury report shows that there is only abrasion.
Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Shiv Shankar Das and
Patna High Court Cr.Misc. No.26439 of 2016 (2) dt.12-07-2016 Shambhu Das @ Shambhu Kumar Das, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in K. Hat Police Station Case No. 102/2016 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
