====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 01-11-2017 Heard Sri Krishna Prasad Singh, learned Senior Counsel, assisted by Smt. Meena Singh, learned counsel for the petitioners and Sri Madan Kumar, learned Addl. Public Prosecutor.
This is second attempt for grant of bail on behalf of the petitioners.
Learned Senior Counsel appearing on behalf of the petitioners submits that petitioners are in custody since 12.09.2015 without trial and, as such, a prayer has been made for extending the privilege of bail to the petitioners. Earlier, by order dated 18.08.2016 vide Cr.Misc.No.32179 of 2016, the prayer for bail of the petitioners was rejected
Patna High Court Cr.Misc. No.47053 of 2017(3) dt.01-11-2017 2/2 primarily on the ground that they were declared permanent absconder in a case registered for the offence under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3 and 4 of the Explosive Substances Act with specific accusation.
In view of the fact that earlier after examining entire material and considering the seriousness of the accusation, the prayer for bail of the petitioners was rejected, there is no reason to review of my earlier order.
