The petitioner seeks bail in Chandramandih P.S. Case No. 96 of 2021, registered for the offence under Sections 379 & 414 of the Indian Penal Code.

As per the F.I.R., petitioner alongwith co-accused Uday Kumar were apprehended with a stolen motorcycle of the informant.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only on suspicion and the alleged motorcycle has not been recovered from the possession of the petitioner. In fact, F.I.R. has been lodged against unknown and name of the petitioner has come in the confessional statement of co-accused Uday Kumar. Petitioner has got clean antecedent and he is in custody since 14.06.2021. Investigation is complete.

Patna High Court CR. MISC. No.52275 of 2021(2) dt.30-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Jamui in connection with Chandramandih P.S.
