2. The petitioner is in custody in connection with Safia Sarai P.S Case No. 94 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 109, 3(5) of the BNS and 27 of the Arms Act.

3. As per First Information Report, it is alleged that petitioner along with co-accused have fired bullet on the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to previous enmity. It is further submitted that allegation of firing upon the informant is against Kaler Yadav not against any other.

Patna High Court CR. MISC. No.44440 of 2025(2) dt.16-07-2025 2/2 It is also submitted that petitioner is in judicial custody since 15.09.2024. Petitioner has got one criminal antecedent as stated in paragraph no. 3 of the bail petition.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that allegation against the petitioner is general and omnibus in nature. No specific allegation of firing bullet against the petitioner he is only order giver in this case. Petitioner is in custody since 15.09.2024.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd, Munger in connection with Safia Sarai P.S Case No. 94 of 2024.
