None had appeared on 08.08.2013 and the case was adjourned for a week. Again the case was listed on 22.08.2013 but none had appeared on behalf of the petitioners. Consequently, the writ petition was dismissed for non prosecution. MJC No. 5038 of 2013 was filed for restoration of the writ petition and the same was restored on 01.07.2015. The writ petition was listed for admission on 19.01.2017 but none had appeared on behalf of the petitioners.

The petitioners sought quashing of order contained in Annexure-1 by which the Municipal Commissioner, vide order dated 11.09.2008, directed the different officials of Patna

Patna High Court CWJC No.15404 of 2008 (5) dt.23-01-2017 2/2 Municipal Corporation to work on their original posts from officiating posts in pursuance of the orders passed in CWJC No. 10584 of 2000 (Suryakant Jha vs. Patna Municipal Corporation & Others) and CWJC No. 11344 of 2002 (Sitaram Choudhary vs. Patna Municipal Corporation & Ors.).

It appears that petitioners have lost interest in pursuing their case.

Accordingly, the writ petition is dismissed for non prosecution.
