ANJANA MISHRA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/ 323/324/448/354/307/379/509/34 of the Indian Penal Code. Diary in this case was called for earlier which has since been received.

Learned Senior Counsel for the petitioner submits that as per the allegation, the petitioner is said to have given a knife blow on the head of one Ram Babu Yadav and the doctor has found the injury to be simple in nature. He submits that there is case and counter case between the parties with regard to the same occurrence.

Considering the nature of allegations made against the petitioner and the injury report as placed in the case diary and also

Patna High Court Cr.Misc. No.49225 of 2015 (3) dt.01-03-2016 P2/2 the fact that there is history of litigation between the petitioner and the informant's side, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Bijaipur P.S. Case No. 48/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
