Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest in connection with Kishanpur P.S. Case No.96 of 2020 registered for offences under Sections 366A, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are next door neighbours and they have not been named by the informant in the FIR. He also submits that the main allegation is against accused Birendra Mukhiya, who is said to have committed rape but Birendra Mukhiya has love

Patna High Court CR. MISC. No.38815 of 2020(9) dt.11-02-2022 2/2 affair with the victim and it is not a case of rape. In the FIR, the informant has named five persons and six unknown persons but has not named the petitioners.

Considering the fact that the petitioners being the covillagers and next door neighbours have not been named in the FIR, this application for anticipatory bail is allowed. Accordingly, let petitioners, above-named, in the event of their arrest or surrender within ten weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No.96 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
