The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/ 323/379/406/420/493/497/120B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner of having false assurance for marriage with the informant is absolutely baseless and concocted. The petitioner is a respectable married man and has no connection with the informant. It is further submitted that there was neighbourhood rivalry between the petitioner and the informant and at the instigation of co-villagers, the present prosecution has been lodged against him making false and malicious allegations.

No.50369 of 2015 (3) dt.18-01-2016 P2/2 Considering the nature of allegations made against the petitioner and also that there is no cogent material indicated in the First Information Report itself which can prima facie make case of the petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur in connection with Sarai Ranjan P.S. Case No. 131/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
