====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through Virtual mode.

Learned counsel for the petitioner is directed to remove the defect (s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in connection with Bakhri P.S. Case No. 87 of 2021, G.R. No. 950 of 2021 registered for the offence under Sections 302, 326/34 of the I.P.C. and Section 27 of the Arms Act.

The prosecution case, in brief, is that the petitioner being the father-in-law of the younger brother of the informant committed murder of the father of the informant, Suresh Mahto, with the help of his companions.

Patna High Court CR. MISC. No.42444 of 2022(2) dt.16-12-2022 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.03.2022. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The name of the petitioner has transpired in the present case merely on the basis of suspicion. Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVIth, Begusarai, in connection with Bakhri P.S. Case No. 87 of 2021, G.R. No. 950 of 2021.
