Petitioner seeks bail in Rudrapur P.S. Case No.09 of 2017 instituted for the offence under Section(s) 376-D Indian Penal Code.

It has been submitted that petitioner is in custody since 17.02.2017. Case has been registered under Section 376-D Indian Penal Code but charge-sheet has been submitted by the police under Section 354/34 Indian Penal Code. Cognizance has also been taken by the Court below under Section 354/34 Indian Penal Code by order dated 16.05.2017. Order of cognizance has been received from the Court below and kept at flag-'B'. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.37870 of 2017 (4) dt.22-09-2017 2/2 above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 2nd, Jhanjharpur, Madhubani, in connection with Rudrapur P.S. Case No.09 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
