JUSTICE SANJAY PRIYA ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Daudnagar P.S. Case No. 127 of 2018, instituted for the offences under Sections 147, 148, 149, 323, 302, 448, 504 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that in the written report, allegation against this petitioner is of assaulting the wife of informant with Damkaua (Wooden danda). There is specific allegation against co-accused Sanjay Ram of causing firearm injury on wife of informant due to which she died. Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.56453 of 2018 (3) dt.11-10-2018 during investigation witnesses in paragraphs 34, 35, 36 and 41 have stated that Sanjay Ram has caused stab injury to the deceased and also made firing on her.

Post-mortem report is available with case diary, wherein doctor has found one stab injury on the neck of deceased. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 127 of 2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
