The petitioners apprehend their arrest in Sultanganj P.S. case No. 184 of 2017under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named four persons, namely, Shailesh, Mukesh, Dharmendra and Ranju Yadav and alleged that Ranju Yadav and Shailesh made indiscriminate firing causing injury to the informant.
The learned counsel for the petitioners submits that petitioners are alleged to have come at the place of occurrence with fire arm but there is no allegation of firing against the petitioners. Specific allegation of firing is made against Ranju
Patna High Court Cr.Misc. No.49032 of 2017 (2) dt.17-10-2017 2/2 Yadav and Shailesh.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar, learned Judicial Magistrate, Patna City, Patna in connection with Sultanganj P.S. case No. 184 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
